1. These terms
These terms are an agreement between you and Circled Fit, a business with a business license in the State of Kuwait that makes Mobou (“we”, “us”). They apply to the Mobou app and to the website mobou.xyz.
When you install or use Mobou, you agree to these terms. If you do not agree, do not install or use Mobou.
Our Privacy Policy tells you how Mobou handles data: https://mobou.xyz/privacy
2. Mobou is a beta
Mobou is a beta. A beta is a test version of a product that is not complete. Thus:
- Mobou can have errors. It can stop, lose data, or work in a way that you do not expect.
- We can change, remove, or stop any part of Mobou at any time, without notice.
- We can end the beta, or your access to it, at any time.
- We do not promise support, a response time, or a level of service.
- Mobou is free during the beta.
- Do not use Mobou for work where an error can cause harm, for example medical, legal, financial, or safety decisions, or systems that other persons depend on.
- Keep a backup of important work. Mobou has a backup export for this.
3. Do not put sensitive information in Mobou
During the beta, do not put sensitive information in Mobou. This includes:
- Passwords, recovery codes, and secret keys (except the API keys that you enter in the Mobou key fields, which Mobou keeps in the macOS Keychain).
- Bank account numbers, card numbers, and other payment details.
- Government ID numbers, passport numbers, and health information.
- Secret business information, and the personal data of other persons.
Mobou sends your questions and their context to the AI providers that you connect (section 5). If you put sensitive information in Mobou, you do it at your own risk.
4. Who can use Mobou
You must be at least 18 years old. If you use Mobou for a company, you agree to these terms for that company, and you confirm that you have the right to do so.
5. Your AI providers
Mobou connects to AI models that you choose, for example Claude, GPT, Gemini, and Grok. It does this through your own accounts, plans, and API keys.
- You are responsible for your provider accounts. This includes their usage limits and their terms.
- You pay all costs of your providers. This includes the costs of work that Mobou starts for you, for example a team discussion that uses more than one model. Watch your usage, and set spending limits with your providers.
- You must obey the terms of each provider that you connect. Some providers limit how their plans are used with other apps. Read those terms before you connect a provider.
- We do not control the providers. We are not responsible for their service, their answers, their costs, or how they handle your data.
- A provider can change or stop a model at any time. Then Mobou can stop working with that model.
6. AI answers
- AI models make mistakes. An answer can be wrong, incomplete, or out of date, even when it looks certain.
- Check important answers before you use them.
- AI answers are not professional advice. They are not medical, legal, financial, or tax advice.
- Mobou Auto chooses a model for each question. The choice can be wrong. You can always choose a model yourself.
- The AI answers do not come from us. They are not our advice, and they do not show our opinion.
7. Actions and approvals
AI models in Mobou can do work on your Mac, for example change or delete files, run commands, install apps, or open web pages.
- Mobou shows an approval card before important actions. Read each card before you approve it.
- When you click “Always allow”, Mobou does the same action again without a new card. For a command, this is the same command text, run by the same program files. A different command, or a changed program file, shows a new card.
- You are responsible for the actions that you approve, and for their results. For example: files that are changed or deleted, commands that run, apps that are installed, and messages that are sent.
- Give Mobou access only to the folders that it needs for your work.
8. Rules of use
Do not use Mobou to:
- Break a law, or help another person break a law.
- Harm, harass, or deceive other persons.
- Get into computers, accounts, or data without permission.
- Make malware, or attack a system.
- Break the terms of your AI providers.
- Send spam or abuse through the feedback box.
If you break these rules, we can stop your access.
9. Your content
- Your content is yours. Your questions, files, pages, and the answers that you get stay yours. Your AI providers’ terms also apply to the answers.
- We do not get a right to your content, because it stays on your Mac.
- You are responsible for your content, and for your right to use it.
- When you send feedback, you let us use it for any purpose, without payment to you.
10. Our app
- Mobou, its design, its code, its name, its logo, and its model scores belong to us.
- We give you a personal, non-exclusive, non-transferable right to use Mobou during the beta. We can stop this right at any time.
- Do not copy, sell, or share Mobou. Do not reverse engineer it, remove its protections, or use it to make a similar product, except when a law lets you do this.
- Mobou includes open-source software. Its own licenses apply to it: https://mobou.xyz/open-source
11. Updates
Mobou checks for updates by itself. When an update is ready, Mobou shows you a notice. The update installs when you click Restart. Some updates can be necessary for Mobou to continue to work.
12. No warranty
Mobou is given “as is” and “as available”. To the full extent that the law allows, we give no warranty of any kind, stated or implied. For example, we do not promise that Mobou:
- Is free of errors, viruses, or data loss.
- Is always available, or works with each AI provider.
- Gives correct, complete, or safe answers.
- Is right for a specific purpose.
13. Limit of liability
To the full extent that the law allows:
- We are not liable for indirect, special, or consequential loss. This includes lost data, lost profit, lost business, and lost time.
- We are not liable for loss that comes from:
- Errors in AI answers, or your use of them.
- Actions that you approved.
- Your AI providers, their service, or their costs.
- Sensitive information that you put in Mobou.
- Access to your Mac or your accounts by another person.
- Events that we cannot control, for example a failure of the internet, of a provider, or of a power supply.
- Our total liability to you is limited to USD 50, or the amount that you paid us in the last 12 months, whichever is more.
Some laws do not allow these limits. Then the limits apply only as far as the law allows.
14. Your responsibility to us
If another person makes a claim against us because of your content, your use of Mobou, or your breach of these terms, a law, or the terms of an AI provider, you will pay for our loss and our reasonable legal costs.
15. The end of these terms
- You can stop at any time. Remove Mobou from your Mac.
- We can stop your access if you break these terms, or when the beta ends.
- Sections 3, 6, 9, 10, 12, 13, 14, 17, and 18 continue after the end.
16. Changes to these terms
We can change these terms. When we do, we change the date at the top. If a change is important, Mobou or our website tells you before the change starts. When you continue to use Mobou after a change, you agree to it.
17. Law and disputes
The laws of the State of Kuwait apply to these terms. The competent courts of the State of Kuwait decide disputes, unless the law of your country gives you another right.
18. Other terms
- These terms and the Privacy Policy are the full agreement between you and us about Mobou.
- If a court decides that a part of these terms is not valid, the other parts continue to apply.
- If we do not use a right under these terms, we do not lose that right.
- We can transfer these terms to a company that takes over Mobou. You cannot transfer your rights under these terms.
